Before we dive into the nuances of the products we provide, we want to make the following statements implicitly clear to all of our customers so that they understand the legalities surrounding the products in our inventory. - Yes- CBD is legal. CBD, although closely related to marijuana is NOT the same as marijuana. CBD is non-addictive, non-habit forming, and will not put you at risk of legal penalty. CBD is legal and available for sale in all 50 states. Because of its legality, CBD can be transported across state lines. Our CBD is available for use in all 50 states. **Although CBD is legal it is not regulated. Essentially, because CBD is not regulated the FDA does not yet back any definitive claims about its effectiveness, healing status, etc.
- The legalities of CBD products are a bit more complex, however, in most states it is legal. Here in North Carolina CBD products is available for consumption for legal adults 21 and over. Therefore, our in-person customers can purchase CBD products at their behest. Like CBD, is still not federally regulated by the United States Government or FDA. However, in some states, there are now protections against selling CBD that requires vendors to adhere to the CBD Consumer Act. The CBD Consumer Act was pioneered in the state of Utah and essentially serves to protect consumers from the non-regulated nature of CBD by requiring certain standards of its quality. As of 2021, CBD is:
- Legal in the following states: AK, WA, OR, CA, ID, NV, MT, WY, UT, AZ, NM, CO, ND, SD, NE, KS, OK, TX, MN, IA, MO, MS, TN, KY, OH, GA, FL, SC, NC, VA, WV, PA, NY, MA, CT, ME, and the District of Columbia. It should be noted there are local ordinances in some states that ban CBD use, as well as other restrictions in certain cities.
- CBD is ILLEGAL in AR, AL, WI, IN, RI, and VT. Use at your own discretion and risk.
- The following states have bills in their houses that will affect CBD laws, resulting in either bans, regulations, or recognition of the consumer act: MI, HI, LA, NJ, and NH.
- The following states recognize the CBD Consumer Act: UT, NV, AZ, and GA.
*For our in-person clientele, the most important takeaway is that CBD North Carolina law recognizes as legal. As a North Carolina-based business, we will stay up to date on any legislature or bills that will affect the sale of CBD in our state. As much as we would like to, we cannot do the same for the other 50 states. Please verify the legalities of CBD in your area before purchasing or taking it across state lines.
- Finally, let’s discuss Delta 8 THC. Delta 8 THC is a more recent development that a lot of people, even those involved in wellness discourse, may be unfamiliar with. Essentially, Delta 8 is a form of THC, the chemical found in the cannabis plant, although it is typically found in smaller sums than traditional delta 9 (what most people commonly associate with THC). Delta 8 does have psychoactive properties and will create a high for those who use it. However, as per the 2018 farm bill, Delta 8 is still considered a hemp product because of its low potency. Ergo, it will not have the same effects as a more potent Delta 9 variant, it will have intoxicating effects.

- However, bear in mind that Delta 8 is not legal in the following states either due to the derivative itself or shipping regulations. Use at your own discretion and risk.
- Delta 8 is not legal in: AK, AZ, AR, CO, CT, DE, ID, IA, MS, MT, RI, UT.
Bear in mind that much like CBD, laws surrounding Delta 8 are subject to change in any state. Especially if legislatures begin to look at it as a controlled substance.
